Terms of service

GigIt (“GigIt”, “we”, “us”) operates the GigIt websites, applications, and related services that let people publish professional profiles, search for specialists, start conversations, negotiate proposals, and track projects.

“You” means the individual who verifies a mobile number and uses GigIt, whether as a client looking for work to be done or as a specialist offering skills. If you use GigIt for an organisation, you represent that you have authority to bind that organisation, and “you” includes that organisation.

GigIt is an intermediary marketplace and communications layer. We are not your employer, agent, insurer, escrow agent, or payment service provider unless a later written product change says otherwise in these Terms.

By requesting an SMS verification code and completing sign-in, you accept these Terms and the Privacy Policy. If you do not agree, do not create or use an account.

You must be at least 18 years old and legally capable of contracting under Indian law. GigIt is intended for users in India. We may refuse, suspend, or close accounts that appear underage, automated, fraudulent, or used to evade a prior ban.

Your account is personal. You must keep your verified phone number and any session under your control. You are responsible for activity that occurs through your account unless you promptly tell us it was unauthorized after you became aware of it.

We may require additional verification (identity documents, professional credentials, or portfolio provenance) before you publish a profile, receive leads, or appear in search. Failure to complete verification may limit features without ending the contract for remaining permitted use.

GigIt provides: (a) profile hosting and directory listing; (b) search, including ranking and matching that may use automated processing and embeddings of content you publish; (c) messaging between connected parties; (d) tools to draft, send, revise, and accept proposals; (e) project tracking, deliverable records, and reviews tied to completed work; and (f) optional AI drafting assistants that produce suggestions you must review before sending.

Unless we expressly enable in-product payments for your account, money does not move through GigIt. Fees, deposits, invoices, GST, TDS, and settlement stay between you and the other party, off-platform. You remain solely responsible for tax registration, invoicing, and statutory deductions.

GigIt does not guarantee that you will find work, hire a specialist, receive a response, or achieve any commercial result. Listings, bios, rates, portfolios, and reviews are user-generated. We do not warrant their accuracy, completeness, or fitness for a particular engagement.

AI outputs (match explanations, draft messages, draft quotations, draft proposals) are assistive only. They are not professional, legal, tax, or medical advice. You must independently verify facts, prices, timelines, and legal commitments before you rely on them or send them to another person.

Specialists act as independent contractors to clients, not as employees or agents of GigIt. Nothing in these Terms creates a partnership, joint venture, or employment relationship between you and GigIt, or between you and another user merely because you met on GigIt.

The commercial terms of any engagement — scope, milestones, price, change requests, intellectual property assignment, confidentiality, and cancellation — are set in the proposal version the parties accept, plus any lawful side agreement they make. Where a side agreement conflicts with a feature limitation of GigIt (for example, off-platform payments), the parties still remain bound by these Terms vis-à-vis GigIt.

GigIt is not a party to the underlying services contract between client and specialist except as an intermediary providing software. We have no obligation to supervise work quality, attendance, or delivery except through tools we choose to offer (reviews, moderation, dispute records).

You retain whatever intellectual property you already own in profile text, photos, resumes, portfolios, knowledge articles, messages, proposals, and files you upload (“User Content”).

You grant GigIt a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (including generating embeddings and search indexes), translate, display, and communicate User Content as needed to operate, secure, improve, and provide the service, including showing published profile material to other users and processors described in the Privacy Policy.

You represent that you have all rights needed to post User Content; that it is accurate in material respects; that it does not infringe third-party rights; and that it is not unlawful, defamatory, obscene, deceptive, or discriminatory in a way prohibited by Indian law.

Published profile, resume, and knowledge text may be processed to create vector embeddings for search and retrieval. Unpublished drafts, private messages, and files shared only inside a conversation are not used as public directory listings, but may still be stored to deliver the conversation and for security, abuse, and legal compliance.

You must not: scrape or bulk-export other users’ personal data; interfere with security or access controls; probe the service for vulnerabilities except under a coordinated disclosure we have accepted; impersonate another person; misrepresent credentials or work you did not perform; send spam or unrelated solicitations; upload malware; or use GigIt to facilitate illegal work, fraud, or money laundering.

You must not circumvent fees or safety features by coercing users to move immediately off-platform in order to hide a scam. Talking off-platform after you are connected is allowed; using GigIt only as bait for fraud is not.

We may remove content, limit distribution, require re-verification, suspend features, or close accounts where we reasonably believe these Terms, another user’s rights, or applicable law are at risk. We may preserve data needed for an investigation, legal hold, or lawful request.

A lead is a request to explore work. It is not a binding contract. A proposal becomes binding between the parties only when the exact revision is accepted through GigIt (or another mechanism both parties clearly agree in writing).

Acceptance of a proposal version converts that revision into a project record. Later change requests should be recorded in GigIt so both parties share the same history. If you agree to changes only in chat or elsewhere, GigIt’s records may not reflect the true deal — that is a risk you accept.

Reviews should reflect a completed project and must not be bought, coerced, or used to defame. We may hide, weight, or remove reviews that appear fake, off-topic, or unlawful, and we may show context such as whether the reviewer was a verified project counterpart.

Search ranking, specialist matching, and assistant drafts may use machine learning models operated by GigIt and by processors (including model providers). These systems can be wrong, incomplete, biased, or out of date.

Significant decisions about hiring or contracting remain yours. GigIt does not take a fully automated decision that legally produces adverse legal effects on you without human channels: you may edit your profile, request correction or erasure as described in the Privacy Policy, and contact us about ranking or listing issues.

You must not use AI features to generate content you know is false and then present it as verified fact, or to process another person’s personal data except as allowed for the engagement and under the Privacy Policy.

The service is provided on an “as is” and “as available” basis. To the maximum extent permitted by Indian law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for fraud, or for death or personal injury caused by negligence where such exclusion is prohibited.

Subject to the previous sentence, GigIt is not liable for lost profits, lost data, reputational harm, or indirect or consequential loss arising from your use of the service, another user’s conduct, off-platform payments, or reliance on AI output. Our aggregate liability for claims relating to the service in any twelve-month period is limited to INR 5,000 or the amount you paid GigIt (if any) in that period, whichever is higher.

You will indemnify GigIt against claims, damages, and reasonable legal costs arising from your User Content, your engagements with other users, your breach of these Terms, or your violation of law, except to the extent caused by GigIt’s wilful misconduct.

We may change these Terms. Material changes will be indicated by a new document version on this page and, where required, by asking you to accept again at sign-in. Continued use after the effective date constitutes acceptance if the law allows; otherwise we will obtain a fresh consent.

You may stop using GigIt at any time. Account closure and data deletion follow the Privacy Policy and any legal hold we are required to honour.

We may suspend or terminate access immediately for serious breach, legal risk, or non-use. We may also discontinue features with reasonable notice where practicable.

These Terms are governed by the laws of India. Courts at Bengaluru, Karnataka, India have exclusive jurisdiction, subject to any non-excludable consumer forum rights you have under the Consumer Protection Act, 2019.

Before filing a claim, you agree to send a written notice of dispute (through in-product privacy/support channels) and allow 30 days for good-faith resolution, except where urgent injunctive relief is needed to stop unauthorized use of intellectual property or personal data.

If a provision is unenforceable, it is severed and the rest remains in force. We may assign these Terms in connection with a reorganisation; you may not assign without our consent.

Legal notices to you may be sent to your verified phone number, in-product notification, or any email linked to your account. Notices to GigIt regarding these Terms should be sent through the in-product Privacy and data rights screens, which create an auditable request record.

These Terms, the Privacy Policy, and any additional in-product consents you grant are the entire agreement between you and GigIt about the service, and replace prior oral or written statements on the same subject.
